What Is Probate?

Probate is the process for identifying and gathering the assets of a deceased person (decedent), paying the decedent’s debts and distributing the decedent’s assets to his or her heirs and beneficiaries.  In Florida, it must be done through the court.  In general, the decedent’s assets are used first to pay the cost of the probate proceeding, then are used to pay the decedent’s outstanding valid claims and debts, and the remainder is distributed to the decedent’s beneficiaries.

Why Do I Need A Probate Attorney?

Most people remain completely unaware of the procedures on how one can inherit or transfer property of the deceased. There are laws governing the probate process and in Florida it almost always requires an attorney.  It is difficult to navigate on your own.  We will walk you through each required step to make sure everything is done according to Florida law and so that property is properly and completely transferred.  We help with formal probate administration and also with summary proceedings.
